Health-Spay/Neuter Contract-Guarantee

This agreement is made, and hereby entered into, on this the _______ day of ______________, 2002 by and between the following parties: Lynn Hunter, hereafter referred to as "Seller", and _______________________________________, hereafter referred to as "Buyer", for the purpose of setting forth the terms and conditions of the purchase by the Buyer of the herein described Chihuahua.

Ownership of the puppy shall be transferred to the Buyer for the sale price of $__________ (shipping costs not included), to be paid in full on or before ____________. Only after the full amount of the agreed upon amount is paid, may the puppy be removed from the Seller?s premises. If the balance is left unpaid by such date as of the _______________, this agreement shall be canceled at the Seller?s option and the Buyer shall forfeit the deposit given hereunder.

You have just purchased one of our healthy vigorous Chihuahua puppies. Every attempt has been made to provide you with the best quality possible.

The Seller warrants that the above-described puppy is in good health and free of communicable diseases at the time Buyer assumes ownership. A puppy purchased from Spice Chihuahuas is guaranteed against Distemper, Hepatitis, Parvo, and Corona Virus for (4) four months from date of purchase, provided immunizations are continued, per our vaccination schedule by a licensed veterinarian and normal care is given to the puppy.

Buyer agrees to have the puppy examined by a licensed Veterinarian within 72 hours (not including weekends or holidays) of receipt of the puppy. Failure to do so will void all health guarantees implied or stated within this contract. Seller is not responsible for any veterinarian expenses incurred at any time.

If, as a result of the examination, the Veterinarian determines that the puppy is not in good health, then the Buyer shall elect to either keep the puppy or return the puppy along with all executed registration documents to the Seller for a replacement puppy.

If the Buyer elects to return the puppy, the Buyer shall within 10 days after the date of the signing of this contract, send to the Seller, by certified mail, a written Veterinarian?s certificate stating that the puppy was in ill health when examined.

NO CASH REFUND IS EVER MADE. A replacement puppy will only be given due to a life threatening illness and ONLY if our negligence is in evidence. The final disposition will be governed by a pathological tissue examination. If a replacement puppy is required we will provide one as soon as we have one of equal value and quality available.

It is the Buyers responsibility to return the puppy to us at our current address. All action taken to return the puppy shall be with the best interest of the puppy in mind, including temperature at time of shipment, non-stop flights, etc.

If the puppy dies within (1) year of age from a problem related to a genetic defect, not here-to-fore called to your attention or sold "AS IS" at a reduction, the puppy will either be replaced with another puppy 100% or at half price according to the conditions involved. (OUR CHOICE.)

Under NO CONDITION will we replace a puppy, where we are not advised of its being ill beforehand, or "put to sleep" without our permission.

The Buyer agrees that any and all transportation cost, to and/or from the Seller?s premises, will be at the cost and sole responsibility of the Buyer.

The Buyer agrees that the puppy?s registered name will include the Kennel prefix "Spice?s" along with an appropriate name of his/her choosing. AKC registered names MUST be approved by the Seller.

The Buyer agrees to maintain preventative health care of the puppy including, but not limited to: inoculations, yearly physical exam by a licensed veterinarian, internal as well as external parasites, heartworm preventative medication, and appropriate diet and exercise. Buyer can contact the Seller about any questions pertaining to this contract or information regarding questions on the care and training of this dog.

The Buyer agrees that he/she is not acting as or in part of, an agent in the purchase of this puppy and that the Buyer will not sell this puppy or any of its progeny to any agent, pet store, or other dog/pet business, or research institution where experimental practices take place.

The Buyer agrees that this dog may not be sold or transferred to any person other than named in this contract. If at any time, Buyer is unable to keep the dog in question, the Seller reserves the first option to take back the dog into their ownership, accompanied by its appropriate signed registration papers, for the price of one (1) dollar. In the case of the Buyer?s death, Buyer should have provisions for Seller to be contacted immediately by Buyer?s family for disposition of this dog.

a. Decide to keep the dog for its breeding/showing program, in which case it will refund the Purchaser at 1/2 the original purchase price as stated else where in this contract.

b. Decide on the basis of condition, conformation and temperament, to spay/neuter the dog and place him/her in a pet home, in which case no monies will be refunded, or

c. Resell the dog to a suitable home, in which case all expenses incurred will be deducted from the selling price and the difference refunded to the original purchaser.

The Buyer shall only transfer the dog to a new owner who has been approved by the Seller. Such approval will not be unreasonably withheld, on condition that the new owner agrees in writing to be bound by all of the provisions of this contract, including the non-breeding if still applicable.

The Buyer agrees that the Seller may repossess the animal upon evidence of neglect and/or abuse at no expense to the Seller, and no refund of any monies will be due the Buyer.

The Buyer agrees that the puppy will NOT be left alone in a backyard or kennel only. The Buyer agrees that the puppy will reside at the home of the Buyer, and have access to a fenced yard, and not be chained or "tied out". Nor live in small cages or crates, except for appropriate crate training for dog shows or housetraining. This animal is sold with the understanding that it will live indoors, be socialized properly, and become a member of the family. Buyer agrees to maintain this dog in a safe environment.

THIS PARAGRAPH APPLIES TO PET QUALITY PUPPIES ONLY.... All Pet/Companion puppies are sold on AKC Limited Registration only. This means that while the puppy will be AKC registered, it is not meant to be used for breeding or showing purposes. Therefore, any puppies produced by it are not eligible for AKC Registration. Buyer agrees to spay/neuter the above named dog within 6 months of purchase. We recommend that you have your puppy spayed/neutered as soon as possible to avoid accidents. A pet quality puppy is meant to be a loving pet and a companion, it is not to be used as a show dog or for breeding purposes. It is eligible to participate in AKC Obedience or Agility Events.

THE FOLLOWING FOUR (4) PARAGRAPHS APPLY TO SHOW QUALITY PUPPIES ONLY. (PET QUALITY PUPPIES ARE NOT GUARANTEED AGAINST ANY OF THE FOLLOWING):

1.) If purchasing a puppy for showing in conformation, we guarantee the following to (2) two years of age: SIZE: not to exceed 6 pounds, BITE: to be Level or scissor, PATELLAS: Not to be luxating TESTICLES: (in males- both to be descended). We do not guarantee, if purchasing a bitch that she will free whelp or not have difficulties in whelping. It is the buyers? responsibility to train and socialize this puppy. If you take it home and do not properly train it and socialize it, IT WILL NOT SHOW. Hard work and training always gain rewards and are your responsibility!!

2.)Buyer further agrees the dog will be shown at sanctioned AKC events with the intent to finish the dog to its AKC championship. If at any time the buyer does not feel that he/she can finish this dog to his/her AKC championship title the seller has the right to show this dog for a period of 6 months, after the correct coat and body condition is attained. There will be no handling fees charged by the seller; however, the buyers do agree to pay to seller all AKC show entry fees and all other expenses incurred (gas, hotel/motel, overnight parking). If for any reason the buyer feels that he/she cannot fulfill any or all of the terms of this contract the seller has the first option of purchasing this dog back per the return terms stated elsewhere in this contract.

3.) The Buyer agrees that this animal will not be used for breeding purposes until it is at least 18 months of age and that it will ONLY be bred to another Chihuahua, which must be registered with the AKC. Show bitch/females will not be bred till they complete their Championship of record with AKC.

4.) Dogs that are placed/sold to show homes will be co-owned by "Buyer" and "Seller" until that dog has completed their Championship of record with AKC, at which time the "Seller" will transfer sole ownership to "Buyer".

A copy of this original contract, AKC registration papers, Health Record, and Care Instructions were received by the buyer at the time of sale. AKC registration papers will be mailed to the buyer within (30) thirty days from the above date, if paying by check.

No other warranties either expressed, written or implied are given concerning the purchase of this puppy.

Should the Seller need to seek legal action against the Buyer for violations of this Agreement, the Buyer will assume any and all attorney costs and court fees, up to $5000.00 allowed in small claims court.

By signing this guarantee and initialing each page, I acknowledge that I have read all of the terms and conditions as stated above and agree to abide by this guarantee.
